Delegarea legislativă - necesitate sau pericol pentru statul de drept
Abstract
The delegation of legislative powers is an institution of the constitutional law and lately it has received added importance in the relation between the Parliament and the Government, nemely in the process of drafting and enacting law-decrees. The present study attempts to present the delegation of legislative powers as found in the comparative law as well a reported to the practice developed recently in our country. This study also tries to present some possible and re dangers posed to the proper functioning of the institutions of the state,the possibility of deformation of the relations between the legislative and the executive folowing the excessive, and sometimes unjustified use of this constitutional instrument. Finally, the paper suggests some solutions, respectively it speaks about the necessity of further reflections over the phenomena of delegation of legislative powers through the prism of the current practice.
