Constituția legislativă și instituțională privind monumentele istorice după 1989

Abstract


The article proposes an approach of the legislative and institutional building in the field of the historical monuments. Based on the understanding of the cultural heritage as a socially constructed sphere, the analysis of the main Romanian regulations in the field adopted after 1989 highlights the relevant actors of the patrimonialization, understood as the process of investing a good with a patrimonial value. Thus, the Ministry of Culture is revealed as the main actor of this process, even if at the beginning of the considered period there were the specialists who have taken the control of the patrimonialization. In parallel, some conclusions on the directions that patrimonialization has taken the last years become apparent: the policies in the field are progressively opening to new patrimonial categories and to the population, the economical dimension of the historical monuments is recognized and valued and, finally, the complexity of this field is consistent with the interdependence between various public policies.
