Administrația publică între drept și managementul public: tensiune și dialog

Abstract


Lawyers and public managers have increasingly diverged in both practice and academia. In this article, which updates a study from 2018, we explore the notion that administrative lawyers have concentrated on a judicial perspective and legal accountability for outcomes. In contrast, public managers primarily adopt an instrumental viewpoint focused on organizational processes and measurable results. We argue that the reluctance of both groups to communicate and collaborate is detrimental from a citizen’s perspective, as both law and public administration aim to influence human behavior. Promoting citizen participation, ensuring transparency in public decision-making, and adhering to good governance principles could serve as a foundation for future collaboration in academia and public administration. Additionally, we address the recent tensions brought about by crisis management and the rise of the algorithmic state.
